We are delighted that the BBC and Donal MacIntyre have won their libel action against the Kent Police. It was shocking that the Kent Police could not, or refused to see, what was obvious to the millions who saw the programme. This programme changed the face of our industry and the BBC should be congratulated on this. It is quite clear that while Mr MacIntyre and the BBC deserve their apology - the residents at the home and their families – who the Police claimed were distressed by the BBC expose – now deserve a full and public apology from the Kent Police.

For the Police to say it was a waste of time investigating abuse of learning disabled adults when they found five assaults in 21 days of filming is a shocking state of affairs. The real victims cannot be forgotten in this and the Kent Police force should apologise to those whose abuse they so publicly denied.

Bereaved mother Brenda Rowley, founded The Malcolm Rowley Trust, in memory of her son Malcolm, who had a profound and multiple learning disability and drowned whilst in the care of Salford Social Services.

The Trust aims to provide Advocacy Services, advice and information through personal contact and more widely via its innovative web site, to those experiencing difficulties with the Health and Social Care sector. Malcolm Rowley Trust is also compiling the first National Data Base detailing breakdowns in the provision of care, which result in serious injury or an avoidable death. The Government is unaware of the extent of this issue as they currently do not collate these figures. The Trust is developing a specialism in Advocacy Services for people with profound and multiple learning disabilities, their carers and families. Despite this group being amongst the most vulnerable in society, state provision of any similar service is virtually non-existent. Although people with this level of disability will receive support from the Health and Social Services throughout their lives, they have no way of expressing their needs or of exercising their rights to choice.

The Malcolm Rowley Trust aims to provide a voice to those who have none.

The Malcolm Rowley Trust is proud to announce that Donal MacIntyre is soon to become a valued patron. It comes as no surprise to learn that Donal is contributing all of his substantial damages award to Charities, one of the beneficiaries being the Malcolm Rowley Trust.
